These Terms of Service govern your use of shop.omicron.uk.com and purchases made through our online shop.
Please read them together with our Shipping Policy, Return and Refund Policy and Privacy Policy.

Throughout these Terms, “Omicron”, “we”, “us” and “our” mean Omicron Engineering Limited.
“You” and “your” mean the person or organisation using the website or purchasing goods from us.
Using our website
You may use our website for lawful purposes and to browse, enquire about and purchase the products and services we make available through it.
You must not deliberately interfere with the operation or security of the website, introduce malicious software, attempt unauthorised access, scrape or harvest information in a manner which interferes with the site, or use the site for fraudulent or unlawful purposes.
We may restrict access to the website where reasonably necessary for security, maintenance, fraud prevention or legal compliance.
Product information
We take reasonable care to describe the products offered on our website accurately.
Many of the parts we supply are for classic vehicles and some applications can vary by model, year, chassis number, previous modification or production changes. Photographs, dimensions and application information are therefore intended to help identify the product but may not always be sufficient to establish that a part is correct for every vehicle.
If you are unsure which part you need, please contact us before ordering. We are happy to help identify the correct item where we reasonably can.
Where an item is used, reconditioned, new-old-stock, reproduction, remanufactured or otherwise materially different from a conventional new part, we will endeavour to make this clear in its description.
Minor variations in colour, finish, packaging or appearance may occur where they do not materially affect the description, quality or function of the product.
Nothing in these Terms affects your statutory rights relating to goods which are faulty, not as described or not fit for a purpose made known to us where the law gives you those rights.
Prices
Prices are shown in the currency displayed by the online shop.
VAT will be charged where applicable and will be shown through the ordering process.
Delivery charges are additional unless expressly stated otherwise and will either be displayed at checkout or separately agreed with you where the order requires an individual shipping quotation.
Prices and availability may change before an order is accepted.
For international orders, import VAT, customs duty and local clearance or handling charges are not included unless we expressly state otherwise. Please see our Shipping Policy for further information.
Placing an order
When you submit an order through our online shop, you are offering to purchase the goods shown in your order.
An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that we have accepted it.
Unless we expressly confirm acceptance earlier, a contract for the goods is formed when we dispatch them.
We may decline an order before acceptance where, for example, an item is unavailable, we cannot reasonably ship it to the destination supplied, there has been an obvious pricing or description error, payment cannot be authorised, we reasonably suspect fraud, or fulfilling the order would be unlawful.
If payment has already been taken for an order which we cannot accept, we will refund it.
Errors in prices or product information
We try to ensure that prices, descriptions and stock information are correct, but mistakes can occur.
If we discover a material error before accepting your order, we may correct it and ask whether you wish to proceed on the corrected basis.
If a contract has already been formed and we discover a material error, we will contact you and deal with it reasonably and in accordance with applicable law. We will not simply substitute materially different goods or increase an agreed price without your agreement.
Payment
Payment must be made using one of the methods offered at checkout or otherwise agreed with us.
Payments may be processed by Shopify, PayPal or another payment provider. Their own terms may also apply to the payment service they provide.
You remain responsible for supplying accurate billing and contact information and for ensuring that you are authorised to use the payment method supplied.
Availability
Some Lancia parts are rare, obsolete or available only in limited quantities.
Stock information is maintained as accurately as reasonably possible, but occasionally an item shown as available may have been sold, reserved, damaged, incorrectly recorded or otherwise become unavailable.
If we cannot supply an item after you order it, we will contact you. We may offer an alternative where appropriate, but you do not have to accept it. If we cannot fulfil the order, any payment for the unavailable goods will be refunded.
Delivery
Delivery arrangements are explained in our Shipping Policy.
The carrier and service used may depend on the size, weight, value, fragility and destination of the goods.
Any delivery date or transit time provided is an estimate unless we have expressly agreed that a particular date is essential.
For consumer purchases, responsibility for the goods during delivery will remain with us to the extent required by applicable consumer law.
Please check that the delivery address supplied with your order is accurate. If you discover an error, contact us as soon as possible. Once a parcel has been dispatched, it may not be possible to redirect it.
International orders
We sell parts to customers in many countries.
Goods imported into another country may be subject to import VAT, customs duty, clearance fees, postal or courier handling charges or other local charges.
Unless we expressly agree to supply an order on a duties-and-taxes-paid basis, these charges are the responsibility of the recipient and are not included in our product or carriage prices.
We will complete customs documents honestly and using an appropriate description and value for the goods. We will not undervalue goods or falsely describe a commercial purchase as a gift.
If you refuse or fail to accept an international delivery because you do not wish to pay local import or clearance charges, the treatment of any returned goods and refund is set out in our Shipping Policy and Return and Refund Policy.
Cancellation and returns
Our Return and Refund Policy explains our voluntary 30-day returns policy and how to request a return.
Consumers purchasing at a distance may also have statutory cancellation rights. Those rights are separate from, and are not reduced by, our voluntary returns policy.
Where statutory cancellation rights apply, we will provide the refund required by applicable law.
Some goods, including genuinely bespoke or personalised goods and items cut or prepared to a customer's specification, may be excluded from statutory cancellation rights where the law permits.

Faulty, damaged or incorrect goods
If goods arrive damaged, are faulty, are not as described or we have supplied the wrong item, please contact us.
We will investigate and provide the remedy required by applicable law, which may include repair, replacement, a price reduction or refund depending on the circumstances.
Nothing in these Terms excludes or restricts statutory rights which cannot legally be excluded or restricted.
Parts ordered incorrectly
Classic vehicles can contain production variations, later modifications and non-original parts.
We encourage you to contact us before ordering if identification is uncertain.
Where we correctly supply the item that was ordered but you subsequently discover that you required a different part, returns are dealt with under our Return and Refund Policy.
Special orders and bespoke items
We may agree to source, manufacture, modify, prepare or cut an item specifically for you.
Where a product is genuinely made or prepared to an individual specification, we may require payment before work or ordering begins and cancellation rights may differ from those applying to standard stock items.
Any important conditions specific to the special order will be explained when the order is agreed.
Title to goods
Ownership of goods will pass to you once we have received payment in full for them, subject to any rights or rules which apply by law.
This provision does not transfer delivery risk to a consumer earlier than permitted by consumer law.
Intellectual property
The website and its original content, including text, photographs, illustrations, logos, graphics, technical information and other material created by or for Omicron, are protected by applicable intellectual-property rights.
You may view and use the website for ordinary personal or business purchasing purposes.
You must not reproduce, republish, commercially exploit or systematically copy our original website content without our permission, except where the law permits it.
Third-party names, trademarks, photographs or other material remain the property of their respective owners.
Third-party services and links
Our website may use or link to services operated by other organisations, including payment providers, carriers and external websites.
We are not responsible for the content or operation of an unrelated third-party website merely because we provide a link to it.
Where a third party provides a separate service directly to you, its own terms may apply to that service.
This does not reduce our responsibility for obligations that legally remain ours as the seller of goods.
Website availability
We aim to keep the website available and operating correctly, but we cannot guarantee uninterrupted access.
We may temporarily suspend or alter parts of the site for maintenance, security, technical reasons or to make improvements.
This does not affect contracts for orders which we have already accepted.
Liability
Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or liability which cannot be excluded under consumer law.
If you are a consumer, we are responsible for losses which are a reasonably foreseeable result of our breach of contract or failure to use reasonable care and skill.
We are not responsible for business losses suffered by a consumer, such as loss of profit, revenue, business or commercial opportunity, where the goods were purchased wholly or mainly for personal use.
If you purchase goods wholly or mainly for business purposes, different legal rules may apply. Nothing in these Terms creates consumer rights for a business purchaser where the law does not provide them.
Events outside our reasonable control
We will not be responsible for delay or failure caused by circumstances outside our reasonable control where we have taken reasonable steps to deal with the situation.
Such circumstances may include serious transport disruption, postal or courier interruption, customs delays, natural events, fire, flood, widespread telecommunications failure, industrial action or government restrictions.
This does not affect rights which applicable law gives you where goods are delayed or cannot be supplied.

Changes to these Terms
We may update these Terms from time to time, for example where our services, business practices or legal requirements change.
Changes will apply from the date the revised Terms are published.
The Terms applying to an order will normally be those in effect when that order was placed. Updating the website does not retrospectively change an existing contract unless a change is required by law or separately agreed.
Severability
If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply so far as they can sensibly do so.
No waiver
If we do not immediately enforce a right under these Terms, that does not mean that we have given up that right.
Governing law and disputes
These Terms and contracts made through our online shop are governed by the law of England and Wales.
If you are a consumer, this choice of law does not deprive you of mandatory consumer protections which apply to you under applicable law.
The courts of England and Wales will have jurisdiction, except where applicable consumer law gives you the right to bring proceedings in another court.
